How much is my rear-end accident settlement worth?

My two-year-old son and I were rear-ended by a GMC Yukon in our Ford Mustang GT. The impact pushed me into two other cars in front of me and was so great that it broke my driver's seat. I went to the ER the night of the accident and was taken again by ambulance a week later because of a muscle spasm. My two year old was examined but doesn't seem to be hurt. There were at least 00 worth of damage to my car that could be seen by the insurance adjuster.

I know that every case is different and I also know that I may need a lawyer, but I was wondering if anyone had a similar incident happen to them and how much they received in their settlement. The truth is I have heard people say that I may only receive a couple of hundred of dollars and I have heard others say that I have a case work maybe ,000-,000. I would like to handle this without a lawyer but I want to ask for a reasonable amount of money.

Also, does anyone know if I can legally receive a settlement for my two-year-old's involvement in the accident even if he doesn't have injuries? (We are in the state of Texas by the way).

I hired a lawyer over a year ago after having my car totaled and reversed lordosis of my neck. I was in er after a ride from ambulance covered in glass and blood. I only missed a couple days of work as I was going to be fired. It took a couple of months before I went to a chiropracter for my neck. The insurance company told me that they wouldn't pay for my neck so I obtained a lawyer. After a year The lawyer told me that he was going to settle for 8,500. He told me that I wouldn't get anymore. I felt I had to settle. He told me that all my bills were paid and I received a little over 2,000 dollars. I checked my credit rating as everything had been put in collections. I called around and he didn't pay all of my bills. I am now in debt. He told me that he had made deals w/ my creditors to pay less. He didn't even pay my insurance co. The 2,000 dollars I was using for a surgery for my cat(bladder stones). I wondered how this would work out as my hospital bills were 3,000 not including any other treatment bills. I have called him about this and asked for a billing break down. He said ok and never bothered calling me back or sending it. It took over a month to even get the settlement check as they had the wrong postage. then forgot to send it then wrong address. I feel stupid now and don't know what else I can do. Any suggestion or personal experience?

I was in a car crash about 4-5 months back .I was hit by a big truck on a freeway .My whole van turned upside down and was totaled .I was with my then 6 month old son (he was not hurt) .I was taken to a hospital in an ambulance and later released I also went to a chiropractor for about 3 months for back and neck pain .I still have the back and neck pain but I have stopped going (its difficult with 2 small kids) . now I have a lawyer and he is doing every thing for me .He has an offer of 2000$ . Is it fair should I ask for more .
P.S. IN the accident report they could not figure out who was at fault.

Ok, here is the deal:

A little over one year ago I was hit head on by a driver under the influence of drugs. She was 100% at fault according to all reports and records. She died on impact, I was taken by ambulance to a nearby hospital. I had a broken wrist, broken toes, whiplash, and 3 herniated discs. Due to the wrist injuries, I have been diagnosed with carpal tunnel, and also, post traumatic stress disorder (while driving or riding only). I have no medical issues or problems before this accident, all were caused by the wreck.

I do have an attorney, I hate Florida – the system is set up so that no doctor will see you without one. So anyway, it is about time for the demand letter to be sent to the insurance company. I have about k in dr bills now.

What can I reasonably expect? I want my bills paid off, but further, the doctor has advised that at some point in the future I will probably need surgery due to nerve damage. The other driver’s policy limits were 0,000.

I’m not looking for an easy score or quick buck, I just want what’s fair, especially considering that I will need surgery some day. And I have been through hell, therapy did not help, nothing has helped. I’m only 30 years old, and will have these issues my entire life because of someone else’s stupid mistake.
Oh, and yes - I will ask my attorney. He and I have something scheduled for later this week, but I'm just curious now. And I'm also afraid he will just tell me an inflated amount. I want real answers, I guess

Recap: 19 months ago, my car was hit by a speeding hit&run driver. Two witnesses provided statements to the police. Car was totaled after flipping 5 times and rolling down a hill. I was airlifted to trauma center with three broken bones, a collapsed lung, and a contusion to forehead. My passenger, a child, was taken by ambulance to an ER, with very few injuries.
I have had physical therapy, one surgery, more physical therapy and am now facing another surgery to repair the fracture that did not heal. Medical bills, paid by my health insurance, are K thus far. Policy limits for uninsured motorist are 100K/300K.
The child's ER bill was 00; child was offered a settlement of ,250 plus 00 in MedPay. I accepted this settlement.

For my claim, I was offered ,000. I do not feel this takes into account my lost wages, my ongoing pain nor my permanent problem with a bone that has yet to heal properly & can only be fixed with another surgery. Still treating; statute runs out 8/08.
There is 0K available due to my state and a law about uninsured motorist coverage. Policy limits would be 200K even tho my policy's limit is 100K per person.
The driver was never found; hit and run.

Rear End Accident Settlement?

I live in California. I drive a 2003 Ford Ranger. I am insured with Allstate. The party who hit me is insured by Progressive. I was involved in a rear end accident nearly a year ago. I was stopped in the fast lane due to traffic stop caused by an accident 1.5 miles ahead. There was a Chevy Tahoe in front of me, also stopped. The injuring party approached me from behind me at a high rate of speed and hit me at approx. 60 MPH. I did see him coming and tried to brace for the impact. The driver's seat was broken in the impact and I ended up under the steering wheel. The Ranger was pushed into the Tahoe. I immediately exited the Ranger, though I knew I was injured, to check on the passengers in the Tahoe. I returned to the Ranger and called 911. CHP, Fire and Ambulance responded and statements were taken. To the best of my information, the offending party was not cited but was found to be at fault and in violation of State statutes. I was transported to Kaiser for treatment, x-rays, medication and medical evaluation. The Ranger sustained significant damage to both the front and rear, in excess of $ 11,000.00. Allstate elected to repair rather than total the truck. I was referred to Physical Therapy, but the sessions caused increased pain, immobility and resulted in an increase of medication to maintain my ability to work. I stopped the physical therapy and have been receiving treatments for lower back pain, immobility and flexibility. The follow on treatments, weekly, have not been charged to either insurance company. My medical costs were approximately $ 3500.00. The treatments after stopping physical therapy have averaged $ 100.00 per week. Progressive has accepted responsibility in this accident. The truck has been repaired, and Progressive has offered a total settlement, verbally, of about $ 7500.00. I expect that this injury will have an impact on me for the rest of my life. I have requested an evaluation through Kaiser, to include an MRI if possible, to determine the long term affects. Progressive is pushing for this settlement.

I was hit head on 2 years ago when a woman crossed the center line in Delaware. The police report stated she was 100% at fault, she was driving her sisters car on a suspended license (her 4th offense), and she gave a false name at the scene. I was taken by ambulance to the ER and released that night. No severe injuries- had 1 orthopedic dr visit for my badly bruised knee, 3 months of chiropractic treatment, and my emergency room treatment (cat scan, xrays, etc). My total medical bills were 14k, my car was totaled and I received 7k for that. It has been over 2 years and the case is still open. The first offer from the insurance company was 12k, and the most recent was 16k. My attorney will get 30% and my medical bills will still need to be paid. I feel that I should get more money since they are not giving me anything for the emotional distress this has caused the last 2+ years. Plus my unpaid medical bills were turned over to debt collectors, which made my credit take a beating. This all seems so unfair for something that could have been so easily prevented if she had obeyed the law and respected the fact that she had a suspended license. My attorney is advising me to take the 16k, but he hasn't been very helpful this entire time. Don't I stand a better chance of getting more for everything that I have been through if I go to court? I'm unsure what to do at this point. I'm not out to get rich, but expect a fair settlement as well.

I was in a car accident back in September 09 the driver made an illegal u-turn on the over pass getting on the freeway as we were going down the over pass we hit head on. The driver was 100% at fault I was taken by an ambulance and I had to stay over night for observation. I had a bad seat belt burn, a swollen left ankle and a very bruised abdomen. How much should I settle for?

Ok so, this passed Friday night, this drunk guy ran a red light and T-boned me caused a 4 car accident. My car was totaled. I went to the hospital when the ambulance got there. My the bones in my hands are bruised, I have whiplash in my neck and lower back and also a cervical strain. My neck is seriously killing me. They gave me pain meds and stuff like that. My mom wants to sue the guy that hit me and I was just wondering how much do you think the settlement would be? I'm not sure what the other drivers are going to do. One of the guys who got hit, left before the police got there..i think he was drunk too. The other guy went to the hospital too..but i don't know if he has any injuries or not.

Does anyone know how much my settlement might be? I'll probably be going back to hospital sometime this week once my pain meds run out.
