Workman's COMP "Settlement Conference"?

My husband was hurt by at work and almost dued one year ago. We are fighting the company's worker's COMP insurance as well as the libality insurance. The problem is, my husband never recv'd payroll cks, always pd in cash. Now we have to prove that my husband was in fact an employee. We just recv'd notice from Workman's COMP that a "Settlement Confernece" is scheduled. We also got another notice from Workman's COMP of a "Trail of Merit" being schedule after the Settlement conference. What does this mean? Does this mean if we cannot come to a "Settlement" amount, then our case goes to trial? What does "Trail of Merit" mean??
OK...Yes, we have filed our taxes and included all monies that my husband has made. We found out (after the accident) that the company did not have worker's COMP and libaility ins on none of the employees. We figured the company was trying not to pay labor costs & higher insurance costs. We also found out that this company has doctored the books to show only a partion of the acutal company earnings (so the company wouldn't have to pay more taxes). This just goes to show you how much you really need to know who you are working for. The only proof that we have is one of the former owners saying "Yes" he was an employee and the 2nd is the current owner has stated that he was an Independant Contractor. Which is stupid on his part, b/c you still have to carry workman's COMP ins on Ind. Contractor's. PLUS...my husband did not work as an IC. All of the definations of an IC do not meet how my husband worked. He even clocked in everyday on a timeclock.
I do have a federal WC attorney.

does anyone have any idea how i could get this done:

injured in 1998, case closed in 2001 - the workers comp ins companies went bankrupt (2), i ended up with lifetime medical for my back with no cash settlement because the california insurance guarantee was covering my case by then.

i have fought for many years to get medical care, it is always a huge problem and many docs stop taking after some time. bills don't get paid and phone calls don't get returned for months, even after calls to supervisor.

i don't know how to go about getting this type of case settled & closed. i've advised the ins co who maintains my claim on behalf of c.i.g.a several times that i would like to settle my case because of these problems, but i am always denied. any ideas ?????

where can I go for legal gelp,(not an attorney)for a case that has already been started?A workers comp. case?My attorney seems to be on the other side and not mine.
I have an open workers comp. case that was about to be settled but my attorney sent me the settlement contracts that state that I have to pay the remaining medical bills.No attorney wants to take my case or give me any kind of advice because of how far along the case is.WHO CAN HELP ME????

My fiance and 2 children (2 & 1) got into an auto accident on the 18th of this december. There are no immediate injuries but my fiance is suffering from neck and back pain causing lack of sleep and my children are suffering from psycological damage. My son is constantly talking about how he is scared of the "broken car" and they are both having nightly nightmares. We are considering a child psycholigist (please mind the spelling errors). Are these things worth compensation? Should we contact an attorney considering that these damages are "soft"? I know that "pain and suffering" is the label these injuries are under but is asking an insurance company to compensate my possibly years worth of shrink visits and associated expenses feasible? Any help would be worth it.

Help! Workers Comp Question!!!!?
I blew out a disc in my neck in 2005. I received and agreed to a settlement offer rated @29% Permanent disability = to ,000.00 & future medical. (offer made 6-06) They made me advance payments totaling ,000.00. Today, I was informed that because I had a separate injury which required Lower back surgery in 2000, in which I was rewarded ,000, that they were combining both payouts, and will NOT be giving me the ,000.00 that was owed on the original offer. I work in Law Enforcement. Two separate injuries in 5 years that one is neck and the other was lower back. How can they combine both isolated injuries in 2 separate areas? This is in California. If I had been shot in the right shoulder one year, and then shot in the left shoulder 5 years later, is the second one for free? How can they do this. Please help guide me in the right direction. Recap: 19 months ago, my car was hit by a speeding hit&run driver. Two witnesses provided statements to the police. Car was totaled after flipping 5 times and rolling down a hill. I was airlifted to trauma center with three broken bones, a collapsed lung, and a contusion to forehead. My passenger, a child, was taken by ambulance to an ER, with very few injuries.
I have had physical therapy, one surgery, more physical therapy and am now facing another surgery to repair the fracture that did not heal. Medical bills, paid by my health insurance, are K thus far. Policy limits for uninsured motorist are 100K/300K.
The child's ER bill was 00; child was offered a settlement of ,250 plus 00 in MedPay. I accepted this settlement.

For my claim, I was offered ,000. I do not feel this takes into account my lost wages, my ongoing pain nor my permanent problem with a bone that has yet to heal properly & can only be fixed with another surgery. Still treating; statute runs out 8/08.
There is 0K available due to my state and a law about uninsured motorist coverage. Policy limits would be 200K even tho my policy's limit is 100K per person.
The driver was never found; hit and run.

A little over a year ago, my husband & I were rearended on our motorcycle by a kid that was high on prescription drugs. We are finished treating and according to our atty. have received a settlement offer. Here is the problem, the Atty. has yet to do anything for 2 months. I keep getting the same run around each time I call. Can I fire him and deal directly with the insurance carrier? I don't have a problem paying the atty for the exact time he had on this case, but I'm tired of playing games, my husband and I could use the money. Any help or suggestions would be appreciated.

Auto Accident Settlement?

My family was in a auto accident 4 weeks ago. I am having HUGE issues with my insurance company and the at fault parties insurance. According to my insurance company my vehicle is fixable (after they bend and square the frame!) and according to the other company it is a total loss. I understand that the other company is willing to pay total loss so that they don't have to pay rental fees and diminished value, but what if I don't want the car back? Can I get my insurance to pay diminished value on a vehicle that has had frame work because I know that when I go to trade that vehicle in the amount I am going to get back is going to be ridiculous!
Secondly, my knee hit the dash (we were going between 35 &40) so I am currently being seen for soft tissue damage. My son (2) had a mark on his neck from the car seat and my daughter (4) is having nightmares. The at-fault insurance company offered me 0 for each child in the accident for I guess pain and suffering. I know insurance companies are not willing to pay out, but that was offensive. My husband was able to walk away from the vehicle but now is having lower back pain, is it to late to have the other insurance pick up his medical bills if he was to be seen? Especially since he told them he had not been injured? (though I told him not to say anything because I know that these things can pop up later) The other insurance company is out of Texas who's liability is 25/50/25 but I know that they are not going to pay out even though the accident has put us in horrible positions. My husband is active duty military and almost got charged with being AWOL because he couldn't make it in to work because we got stranded in Oklahoma (we live in New Mexico). Then I had to drive him to work, drive back to Stillwater turn in the rental, wait for him to drive our other vehicle back and pick me and my children up, then drive us back. It's been a nightmare!
Should I just hire an attorney and get it taken care of and loose all this stress?

When you are cut your check for PAIN & SUFFERING & MEDICAL ONLY, is it only for those involved in the car accident or all those who own the car?
We've already been reimbursed for the vehicle itself and that was cut to all owners of the car I was just curious .

does it matter that our daughter was involved in the accident as well (she was not injured)

I am thinking about using the money to leave my husband (he also owned the car, which we were paid for, but he was not in the vehicle when it was struck)

See our attorney is husbands' family & I am afraid att. will try to make the claim that the check should be in both our names since it could be said husband is the one working which is how we got the money to pay the medical bills in the first place.

I was just curious if husband had a claim on this "medical/pain & suffering" money that I may be recieving.

I find it interesting that the insurance company offered our daughter money even though she was not injured. She was terrified though.
