auto accident settlement phase, tell me how much to ask for?

I'll pick the best answer based on who I think provides the best answer with the most accurate dollar amount. No, the highest dollar amount does not automatically win. Looking for honest experienced opinions.

1. Sitting at a red light a drunk driver hit us from the rear at 20 mph as explained in the report. I feel he was going 30-40 mph.

2. He tried to flee, but was caught, several wittnesses no question to fault. Driver charged with 4th DWI and 2nd hit and run.

3. his car damage was 00 our was 00.

4. We are three passengers. All experienced neck & back soft tissue damages. Child experienced partially dislocated shoulder and same neck problems. Medical bills for all three totaled ,000.

5. Self employed, so no lost wages, child suffered absences from school, fell behind.

6. First three weeks we all were medicated, caused vomitting and ruined vacation plans. 00 vacation.

How much is this claim worth? Keep in mind, 4th DWI, hit&run aggrivated situation.
No I don't consider it a lottery. I have no idea what I am entitled to. To the last lady ,000? Please, the medical bills alone are ,000! I don't ant a jackpot, just what I am fairly entitled to! We were injured, period, we suffered and still are, period. My daughter will have issues related to her education and sports. And please, I may not be an attorney, but through the 4 DWI and hit and run in front of a jury and see where it goes! We both know society does not tolerate this and it WOULD show in a jury awarded settlement whether the law states it or not!

Last, you must also remember that any future injuries no matter the circumstances would be scrutinized based on this accident. Get hit again and have similar injuries and they will lessen your claim. It's almost like a 1 time deal for these parts of your body for life! The settlement has to right.

My spouse & I are in serious financial problems. I think we need to file bankruptcy because he has stopped paying his credit cards. i'm keeping up with the utilities and my own credit cards. we own 2 homes, 1 of which is on the market and my spouse refuses to bring down the asking price and now the morgage company has started foreclosure on that property. he's been able to sort of keep with the morgage payments on the home we live in. my ? is, is debt settlement a good option? I don't know where to turn to anymore. My spouse wants to "keep up the fight".

My father used to work as a D&A counselor at a CT prison. During the course of his work, he was injured and is unable to work any longer. His claim is undisputed by the State of Connecticut but hasn't been paid a settlement as he was told the State of Connecticut isn't paying settlements because they have no money, and its been over 12 years since he was injured. Does anyone know if this is true, that CT isn't paying workers comp settlements due to lack of money?

My lawyer says he cannot ethically give information to an advance loan company & the loan cannot go forward without his cooperation but he's had my case since September of 2005 without results. Not even a response from the insurance company involved since he made the first demand in August 2007. I don't think my case is very important to him & I really need the money. There seems to be no recourse to make him take some action. Very frustrating.

Do different states have different laws regarding this matter.I put a claim in for about 00 & got a check back for 00 with no explaination or itemized breakdown as to what they paid for & no sign of a voucher for all the inconvenience.

First off, I don't want to hostile with them. But I DO want to be firm on what I can and can't do.

I have a debt that I want to pay off, but I cannot pay the full amount which is around 5,000. This is from 2005. Now they're telling me if I settle I only have to pay half. I asked if there's a chance I could pay less. They told me none of their clients have ever settled for less than half.

I wanted to do a settlement, but they require I do this quickly. The first payment within 7 days of the agreement and last payment within 30 days. I can't get that much within that time.

I told them I do not have money this month as I have paid my bills. They said, "To be honest, since this has been in our records so long, by the end of this month it will probably be moved to our legal department for further action. If you put down now that will keep this file on my desk. Then you could pay next month & bring that amount down. Then we can talk about a settlement." I'm afriad to put ny money down in case they say I can't do a settlement later.

So I told them that I will c/b in the morning. They said they can't extent the settlement and I can't make payments on it. Any tips or suggestions? What I should do or not do? I told them I really want to give them what I can, but I can only give so much.

I, the driver, going 40 mph (the speedlimit) was hit by a hit & run driver at 90 mph; my car hit a tree, a fence, and rolled 5 times down a hill. The other driver never stopped and was never found; two witnesses gave police statements. It was determined not to have been my fault. My child in the passenger seat was taken by ambulance to local ER; xrays and treatment and ambulance totaled about 9K. My child was sore for a few days and only has a small scar on his hand.
I was airlifted to a trauma center with fractured collarbones, collapsed lung, broken rib and assorted bruises, and hospitalized for 4 days. The bones are still healing. I went to physical therapy for 2 months and had cortisone shots in my shoulder. My total medical bills were about 40K.

Car was totalled.

Although I am still having pain when going about normal household chores and my right shoulder healed slightly deformed, the ins lady wants to offer me a settlement. Any advice?

I live in NC. I was rear ended on an interstate off ramp by a tractor trailer. I had been forced to come to a complete stop because the 5-6 cars ahead of me had stopped. The tractor trailer was going about 7-9mph at the time. I was driving a Ford Explorer. There were only scratches on my bumper from the accident. The guy's insurance company just called to let me know they would pay for me & my 2 children's (5 and 10 year olds) medical bills and give me 0 for the scratches on my car. The medical bills came from going to the doctor to see why we had headaches the following day. Plus my neck hurt so bad I could not turn it without pain and my right eyelid was drooping for some reason. I missed a week out of work due to pain & drowsiness from the muscle relaxants my doc prescribed. Accident was 1-1/2 weeks ago ,Oct.13 2006. I didn't do a police report cause an officer directing traffic in the area said damage to my car was too minor to file. Is 0 + medical bills a fair settlement?
Sorry, I guess my question was not clear. The guy's insurance company offered to pay me 0 for damages to my car and to pay for me & my children's medical bills. I kinda think they should also compensate me for the money I lost from not being able to go to work for a week and for our pain and suffering since I did not cause the accident. I do not know if I will file a small claims case or not.
