How much much money to ask for car accident settlement in Texas?

My family and I were involved in an auto accident where we were going down the highway at 55 mph on cruise control and a lady turned directly in front of us without even giving time for us to hit the breaks. We hit her almost directly head on; we ended up in a ditch, and her car wound up spun the opposite direction that she was headed to begin with. It was a terrible wreck.

My son had flown in from California (He is a Marine) and we were on the way home from the airport when this happened. My daughter (who was supposed to ship to boot camp for the Army the next day) broke her nose and bruised her hip, my granddaughter (One year old) got her tooth chipped, I have a possibly cracked rib, and my son is still on light duty two weeks later. My daughter cannot go to boot camp for another 2 months now and her nose will never look the same, my son's three day trip home was ruined and painful, and my grandbaby's tooth may never look the same!

What should we ask for?

Here's what we're hoping to recieve: repayment for the purchase of a new carseat (Graco website says to never use one after it's been in a wreck), money for the 2001 Tahoe that was totalled, medical bills reimbursed (2 ER trips, 2 painful nose sraightening appts for my daughter, Dr appt for my ribs, ortho and dr appt for my granddaughter), payment for miles & gas to those places since we opted out of a rental car and just used my daughter's car (trying to be nice), but we have no idea how much to ask for 'pain and suffering.' And should we ask for my son's plane tickets to be reimbursed as well?

We aren't looking to be gold diggers, but we don't want to come out behind because of this, and let's face it, no one ever gets enough money to replace the vehicle they had with a true equivalent.
The insurance company just offered 50.00 for our 2001 Tahoe ls. It was in EXCELLENT shape with after market leather with the chevy logo embroidered on the front seats. 170,000 miles, new over sized tires, and a recent transmission installed

My fiance and 2 children (2 & 1) got into an auto accident on the 18th of this december. There are no immediate injuries but my fiance is suffering from neck and back pain causing lack of sleep and my children are suffering from psycological damage. My son is constantly talking about how he is scared of the "broken car" and they are both having nightly nightmares. We are considering a child psycholigist (please mind the spelling errors). Are these things worth compensation? Should we contact an attorney considering that these damages are "soft"? I know that "pain and suffering" is the label these injuries are under but is asking an insurance company to compensate my possibly years worth of shrink visits and associated expenses feasible? Any help would be worth it.

Had a very bad car accident summer of 2007. Have had shoulder surgery for a torn rotator cuff, have had surgery on each arm for nerve damage due to compression from impact onto steering wheel, still having neurological issues from 5 herniations in my cervical spine. C2, C3, C4, C5, C6 are all severely herniated, C4 and C5 are pinching into my spinal column and I am experiencing periodic numbness in my body, not loss of control of my body but just a pins and needles feeling in parts of my body from this herniation. I am going to have neck surgery because of this, surgery is set for march of this year...The driver that hit me ran a red light and sideswiped me. She is a highschool student that lives in her parents house...she is 18 and lives in her parents home because she was going to be a senior in highschool that fall....my lawyer called and told me he has recieved a call from the girls parents insurance company, whom she is insured with under her parents policy...they have a 50,000 policy...the insurance company have offered the full 50,000 and want her to settle. I asked the lawyer what my options were because I have such devistating injuries, can I go after their assets, or home owners insurance beings she was a driver under the parents and they dont have low insurance...they own a 430,000 dollar home, the father drives a 50,000 truck, the mother drives a new caddillac escalade, he owns a large trailer that hauls vehicles...the trailer is very valuable, over 20,000 dollar enclosed trailer. the lawyer says that I can get the 50,000 policy and cant go after homeowners but my question is, I am told that when a child of a parent is living in the home and driving, a parent should have an umbrella policy in case the child driving causes a devistating auto accident that results in severe injuries, so they cant lose their home....my lawyer seems really eager to settle this case and I haven't even had my neck surgery yet...he says my own insurance PIP that I have will cover all surgeries that I need and give me all the medical care that I still need until I fully recover, but I am very angry and extremely upset because my injuries are worth way more than 50,000 dollars minus the lawyers 1/3 fee...I have had several surgeries and I am going to have a fused neck because of surgery that is needed, and my neurological health is still at risk...I want to know my options, I am afraid to go to another lawyer to ask advice but I need to know what I should do so I don't screw myself out of compensation...I live in northern new jersey and I want to know if anyone knows what my options are....can I get the 50,000 off of their policy and then file a civil suit in court against them and go after all of their assets and when I win in court because she is found to be 100% negligent because she ran a redlight and hit my car at a high rate of speed 60 mph side impact...when I win would they be ordered to pay by a judge and all of their assets, including their home or whatever have a lein put against it??? I dont want to come across as a snake here but I am really in a bad position because I am permanately disabled from this accident and lost a career and a large part of my life as I knew it and I dont want to settle this out for peanuts....thanks..
just looked at all paperwork and girl that hit me was NOT 18...She was only 17 at the time of the accident. She was a 17 year old senior in highschool....I want to know if her being under 18 changes anything with the fact that she is a minor and still the responsibility of her parents....does this make my case better or does it stay the same..thanks

My family was in a auto accident 4 weeks ago. I am having HUGE issues with my insurance company and the at fault parties insurance. According to my insurance company my vehicle is fixable (after they bend and square the frame!) and according to the other company it is a total loss. I understand that the other company is willing to pay total loss so that they don't have to pay rental fees and diminished value, but what if I don't want the car back? Can I get my insurance to pay diminished value on a vehicle that has had frame work because I know that when I go to trade that vehicle in the amount I am going to get back is going to be ridiculous!
Secondly, my knee hit the dash (we were going between 35 &40) so I am currently being seen for soft tissue damage. My son (2) had a mark on his neck from the car seat and my daughter (4) is having nightmares. The at-fault insurance company offered me 0 for each child in the accident for I guess pain and suffering. I know insurance companies are not willing to pay out, but that was offensive. My husband was able to walk away from the vehicle but now is having lower back pain, is it to late to have the other insurance pick up his medical bills if he was to be seen? Especially since he told them he had not been injured? (though I told him not to say anything because I know that these things can pop up later) The other insurance company is out of Texas who's liability is 25/50/25 but I know that they are not going to pay out even though the accident has put us in horrible positions. My husband is active duty military and almost got charged with being AWOL because he couldn't make it in to work because we got stranded in Oklahoma (we live in New Mexico). Then I had to drive him to work, drive back to Stillwater turn in the rental, wait for him to drive our other vehicle back and pick me and my children up, then drive us back. It's been a nightmare!
Should I just hire an attorney and get it taken care of and loose all this stress?

I was involved in a auto accident where someone hit me from the back. The wreck fractured two bones in my back. L1 and L2. I have been released from my doctor last month with the statement that I am as good as I am going to get. The doctor thinks I might suffer some very bad back pain for the rest of my life. The guy's policy is 50/100/50. My entire family was in the car which is 4 people, my wife suffered Siatic nerve damage? and is also released. My kids were fine except for muscle pain. According to the car accident auto policy it's saying my claim is worth only 40000 that is just retarded! There's noway it's only worth that. What can be done? My company has already said I cannot work in the field again that I will have to be office bound for the rest of my career and i'm 25!

I was involved in an auto accident in August of which I was not at fault. I was hit by a commercial van with a lapsed policy. The claim is against my Insurance Co. Uninsured Motorist Policy which has a cap of ,000. My insurance Co. has taken care of the damage to my vehicle as well as PIP of 2,500 towards my medical cost. I suffered a lumbar herniated disc as well as "soft tissue injury" to my mid-back and neck. Excluding my PIP my medical cost amounted to 10,500 including MRI's and Xrays. I decided from the beginning to not get a lawyer. When I felt I did not need continous treatment I called my insurance co. to settle. The initial offer was 7,500 to settle and by the time we were getting of the phone it was raised t0 10,000. This still did not cover my medical or any future medical cost. I spoke with them today and they offered 11,000 and said it was there max offer. Again, I said no that it did not cover me at all for future treatments. BTW I was treated for 3 months for my injuries and I am still in a lot of pain if I move the wrong way or try to lift things. Since the accident I am not able to do things I was able to do prior. In the last month I have spent 1,000 to make repairs to my home I would have done my self.

***** My questions: Is this a fair offer? If not what would be a fair counter? Or should I just get a lawyer?

I am not looking to get rich! I know this was an accident. However, I do not want to pay out of pocket for future treatment or just that fact I can't do what I used to.

When the say final offer or the max for my claim is that true?
The accident occurred in Virginia. I do have medical insurance that has covered a portion but will need to be reimbursed following settlement.

In the accident I was pregnant with my son, who was born 2 days after the accident due to a placenta abruption caused by the car accident. we are about ready to settle, but i dont know what HIS case is worth, could i get some help? has this happened to anyone you know, and could i get there stories? thank you all sooo much! I'm doing this with out the help of an attorney.
after he was born 1 month early due to the auto accident, he was put in the NICU for 3 days on oxygen and feeding tubes.

I was in an auto accident that was NOT my fault last August. An 18yr old kid talking on his cell phone pulled out in front of me. So far his insurance paid the 00++ to have my car fixed. Two weeks of rental car. I have 00 in Doctor bills that my policy as part of my policy is paying up until 00. When we settle they get the 00 first. I just finished physical therapy and they (the therapy place) are going to wait on the settlement to get paid. Having never been in an accident I do not know what to expect. I am going to have to settle soon as when that 00 limit hits I will have to pay the doctor bills and I cannot afford it. It has made my pre-existing conditions worse forever. doc has stated this in letter.

Anyone have any idea how much I should expect from the company for ongoing treatment? My insurance company says it will not cover the rest of my life but an allowance will be made. He will not guess at an amount. Since I will have to settle early and not the 2 year

Question for auto accident adjusters .... settlement question.?
My wife and myself had an accident a few months ago and we are now finished with treatment. We both recieved whiplash , neck pain , and lower back pain. We both still have some days, where our necks feel tight and some lower back pain. --- I wanted to know what my case is worth. Here are some of the details.. The car was hit from behind causing $ 6,500 worth of damage to the car and the ins. has already paid for that. The EMT's did come to the accident and transported my wife to the ER. Both of us went to the doctors office a few times and each had a few X-ray's and I had a CT scan. My wife also had a few weeks of physical therapy. Medical bills total $ 4,106.00 and lose wages $ 838.00. I have been told that you are able to get 2 times your medical bills and time lost. Is this right ? Please give me the best answer you can and tell me what you might settle the case for. Thanks

I recently got into an auto accident in which it was the other drivers fault. Her insurance company agreed to pay a body shop to fix my truck. The problem is I found a buyer who wants my truck as is. Can I get the insurance company to write the check to me and spend it any way i want? Is it possible the could offer me a lower settlement in personal payment?
